1. Basis of Contract

1.1 These terms set out the whole agreement between you (“The Customer”) and us (“BRC Stone Works”, trading from Foxes Barns, Binsted Lane, Arundel, BN18 0AL) for the sale of goods and/or provision of services. Please read and understand these terms and check that your order is complete and accurate before committing to the contract.

1.2 You order and agree to buy, and we agree to sell the Goods and/or provide the Services at the Price, subject to these terms and conditions.

1.3 Products which are not standard and are specifically ordered or fabricated for you must be paid for in full before the order/fabrication will be processed and cannot be cancelled after the order/fabrication process has started.

1.4 Prices and delivery charges are those in force at the time you submit your order. If prices or charges differ from those published, this will be brought to your attention before we accept your order, giving you the option to cancel.

1.5 You should be aware that natural stone products require a level of treating and aftercare. Some may be susceptible to scratching, natural pitting, or chipping. Entering into this agreement is acceptance of the above.

2. Conditions Applicable

2.1 These terms are the express terms and conditions governing the Agreement.

2.2 There cannot be a variation or change to these Terms and Conditions unless agreed in writing and signed by both parties.

2.3 In placing an order, you warrant that you have the necessary permission and authority to enter into this Agreement. It is your responsibility to check that all details relating to your order are correct and to provide us with all relevant information relating to the environment in which the Goods are intended to be used.

2.4 It is important that you check your measurements carefully. An order should always include an additional 10% to allow for wastage, cutting, minor imperfections (as expected with natural stone), and breakage. If you do not order enough, subsequent goods may not be exactly the same as the original goods due to natural variation.

2.5 We can provide estimates of quantities but these will be based on general guidelines and the measurements you supply. It is your responsibility to provide accurate measurements. We will not be responsible for any shortfalls or surpluses. Surplus goods are not returnable or refundable.

2.6 We cannot be held responsible for circumstances beyond our reasonable control, including shortfalls at source, natural disasters, and restraints or delays affecting suppliers or transportation.

2.7 We strongly advise you not to book your installation until you have received your order in full and inspected the goods.

2.8 We will not be responsible for fitting costs or penalties relating to delayed deliveries.

3. Description and Samples

3.1 All descriptions, images (in print and online) and samples of our Goods are for the purpose of giving an approximate representation only.

3.2 You acknowledge that the Goods are natural and geological variations will occur in terms of colour, markings, veining, texture, and size between consignments, which are beyond our control. We advise you to view as much of the Goods as possible before entering into this Agreement.

3.3 You should be aware that all natural stone is porous to some degree and should be sealed. Some materials may be susceptible to scratching and/or natural pitting/chipping.

4. Pricing and Payment

Trade/Business Sales

4.1 If you are a registered business, please contact us for a bespoke quote. Trade prices apply. All trade prices are exclusive of VAT.

Consumer Sales

4.2 The Price is as indicated on our website, inclusive or exclusive of VAT as stated. Delivery charges are additional.

All Sales

4.3 We reserve the right to change the Price by giving notice before delivery to reflect increases in cost (foreign exchange fluctuations, duties, material costs, etc.). If we change the price and you are not satisfied, you may cancel your order.

4.4 Payment is required on placement of your order. We will not arrange delivery until we are in receipt of cleared funds. Payment must be made by BACS, Credit or Debit card.

4.5 Failure to pay will result in delivery being delayed until funds are received. We reserve the right to charge interest on outstanding payments at 3% above the current UK base rate.

5. Delivery

5.1 Delivery dates are estimates only and not contractually binding. We shall not be liable for any failure to deliver on a particular date.

5.2 It is your responsibility to ensure adequate access for delivery. We will not undertake delivery over ground we consider unsuitable for our vehicles.

5.3 You must inspect goods upon delivery and report any damage within 48 hours with photographic evidence.

6. Templating and Fabrication (Bespoke Orders)

6.1 For bespoke worktops, vanity tops, and cut-to-size orders, a template will be taken before fabrication.

6.2 The customer or appointed representative must be present during templating to agree all relevant details (overhang, joints, edge profiles, cut-outs).

6.3 Following templating, if furniture or units are adjusted or moved, we may not be able to carry out the fitting. Additional costs may be incurred for re-templating.

6.4 A 50% deposit is required at order confirmation. Balance payment must be made before fabrication begins.

6.5 Changes after template are accepted only if fabrication has not started. We accept no responsibility for changes requested after fabrication has begun.

6.6 Missed appointments or cancellations after template are subject to a £270 + VAT charge.

7. Installation Services

7.1 All quotes are based on ground floor installation within a 40-mile radius of our premises. Additional charges may apply for upper floors or greater distances.

7.2 We require clear working areas free of hazards. The customer is responsible for removing old surfaces unless otherwise agreed.

7.3 The customer or representative must be present during installation to sign the job satisfaction sheet upon completion.

7.4 We reserve the right to refuse to fit to units we deem unsatisfactory. The customer will be liable for any expenses incurred in rescheduling.

7.5 Following installation, inspect carefully. We will not be held responsible for damage found after our team has left unless reported within 5 days.

7.6 All worktops require 24 hours for adhesives and silicone to cure. Do not use worktops, cabinets, or drawers during this period.

8. Landscaping and Masonry Services

8.1 All landscaping and masonry quotes are based on information provided and a site survey where applicable.

8.2 Additional costs may arise from unforeseen ground conditions, access issues, or changes to the agreed scope of work.

8.3 A deposit of 30% is required before work commences. Stage payments will be agreed for larger projects.

8.4 We will make every effort to minimise disruption but some noise, dust, and temporary mess is unavoidable during construction work.

9. Cancellation and Returns

9.1 For standard products ordered online, consumers have the right to cancel within 14 days of delivery. See our Returns & Refunds Policy for full details.

9.2 Bespoke, cut-to-size, and specially ordered products cannot be cancelled after production has begun.

9.3 All end-of-line and clearance items are non-refundable.

10. Liability

10.1 Our liability is limited to the price paid for the goods or services in question.

10.2 We are not liable for any indirect, consequential, or incidental losses.

10.3 Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Natural Stone Characteristics

11.1 Natural stone is a unique material. Colour variation, veining, fossils, mineral deposits, and natural markings are inherent characteristics and are not defects.

11.2 Samples and images are indicative only. The actual product may differ from samples shown.

11.3 We cannot guarantee pattern matching at joints or vein direction unless a bespoke matching service is agreed (additional charges apply).

12. Governing Law

12.1 These terms are governed by the laws of England and Wales.

12.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
